GENERAL TERMS AND CONDITIONS OF SALE
(The “Website” is a site operated by Gloria Bass Design Inc., hereafter referred to as “Gloria Bass” or “we”. Use of the Website is subject to the following Terms of Use (the “Terms”). Gloria Bass Design may revise these Terms from time to time by updating this page, with the revised Terms taking effect for all users as of the date stated on the posting. Your continued use of this Website following the posting of any changes indicates your acceptance of the changes. You should consult the Terms regularly.
Please read the Terms carefully before using the Website. You expressly acknowledge that you are aware of these Terms and have had access to the same upon entering the Website. Your use of the Website constitutes your agreement to the Terms. If you do not agree with the Terms, please do not use the Website.
ORDERS
If you have reached the age of majority or (legal age) in your jurisdiction (typically 18 or 19 years old) and only if you can enter into legally binding contracts under applicable law, you may place orders for Gloria Bass Design products. We do not accept orders by email. All orders are subject to written acceptance by Gloria Bass Design. It is your responsibility to check that the information displayed in your Shopping Bag accurately reflects your selection before confirming your order. Upon confirmation (i.e., clicking the “Place Order” button as explained below), the order will be sent to Gloria Bass Design for processing and, within twenty-four (24) hours, you will receive an acknowledgment email. Gloria Bass Design also reserves the right to require verbal confirmation of orders. If we request verbal confirmation of an order, you shall give confirmation by phone and email confirmation will not be sufficient.
The images of the products on our Website are for illustrative purposes only. Although we have made every effort to display the colors and style accurately, we cannot guarantee that a device’s display of the colors accurately reflects the color of the products, nor the exact style due to individual handmade craftsmanship. Your products may vary slightly from those images. Accordingly, Gloria Bass Design shall not be liable for any error or inaccuracy in the photographs or graphical representations of Gloria Bass Design products displayed on the Website. Orders may be placed for personal use only, any commercial use excluded. Gloria Bass Design has the right to cancel any order placed by you in the event you have been involved in a dispute concerning a prior order, or if Gloria Bass Design has reasonable ground to suspect that you have violated these Terms and Conditions, or are or appear to be engaged in fraudulent activities or use of purchased products other than for personal use as permitted by these Terms and Conditions. Gloria Bass Design has the right to refuse any order at its discretion.
CONFIRMATION OF ORDERS
In order to process the order, you must select the product you wish to buy and click the “Add to Cart” button. The selected products will then be included in the “Shopping Cart” and the order can be placed by filling out the order form and accepting the General Terms and Conditions of Sale (i.e., these Terms and Conditions). Prior to submitting the order, you are given the opportunity to verify the accuracy of the information provided and make the necessary corrections. The order is submitted when you click the “Place Order” button. After placing an order, you will receive an e-mail confirmation from us acknowledging that we have received your order. Please note that clicking the “Place Order” button does not mean that your order has been accepted and purchase completed. Your order constitutes an offer to us to buy a product. Upon receipt, the order will be submitted to Gloria Bass Design for processing and may not be changed or cancelled except as expressly provided in these Terms and Conditions or as required by applicable law. All orders are subject to acceptance by us, and we will confirm such acceptance to you by sending you an e-mail that confirms that the product you have purchased has been dispatched and which contains the relevant tracking number (the “Order Confirmation”). The contract between us will only be formed when we send you the Order Confirmation. The contract will relate only to those products whose dispatch we have confirmed in the Order Confirmation. Gloria Bass Design files for its own records evidence of all transactions between Gloria Bass Design and its customers. Download and file for your own records these Terms and Conditions and the Order Confirmation. In the event of a dispute between Gloria Bass Design and one of its customers relating to a transaction conducted on the Website, the data recorded by Gloria Bass Design shall be treated as evidence of the details of the transaction.
AVAILABILITY
Gloria Bass Design reserves the right to change the assortment of items offered on the Website from time to time without prior notice to you. Gloria Bass Design will not be liable if any product is out of stock or otherwise unavailable.
In the circumstance that any product you select becomes unavailable after confirmation of the order, we will inform you by phone or e-mail as soon as possible. You will have the option to choose another product or cancel your order, unless the order which was made was a multiple order, in which case we will inform you by phone or email of which part of the order will still be shipped. You will only be charged for the part of the order which is shipped and may then choose another product to replace the unavailable product, which will be processed as a separate order.
PRICES AND PAYMENTS
The prices of Gloria Bass Design products are indicated in Canadian dollars excluding applicable taxes and shipping costs. Gloria Bass Design reserves the right to modify the price of products offered on the Website at any time without prior notice to you. You will be charged the prices displayed on the Website at the time the order was confirmed by you by clicking on the “Place Order” button. You are responsible of the costs incurred when using means of a distance communication in connection with placing an order with us (cost of internet access, telephone costs), and these costs do not differ from the standard rate. Gloria Bass Design reserves the right to correct any errors or inaccuracies on the Website or to cancel orders if any such information is inaccurate. You will be required to pay for any order placed on the Website immediately upon clicking on the “Place Order” button. The amount of the purchase price of the product(s) ordered by you will be blocked on your credit or charge card but you will only be charged upon receiving a confirmation from Gloria Bass Design. We only accept payments through Interac, credit and charge cards, or gift cards. You cannot use store credits to purchase products offered on the Website. All orders are payable in Canadian dollars. We accept the following credit, charge and debit cards: American Express®, MasterCard®, Visa®, Discover®, Diners Club®, and Interac®. Your credit, charge or debit card will only be charged when your order is confirmed by Gloria Bass Design. If any of the products are unavailable, Gloria Bass Design will only charge the price, taxes and shipping costs for the products available.

Gloria Bass Design charges applicable sales taxes as required by the applicable law taxing authority as detailed below.

DELIVERY ZONE
The products will be shipped to the delivery address provided during the ordering process. You must provide a single address for each order. Please note that PO Boxes, freight forwarders and hotel addresses may not be used for the delivery of our products.
SHIPPING
During the ordering procedure, Gloria Bass Design will inform you of the standard time required for delivery and the various forms of delivery available for the goods purchased. You will be asked to select the shipping method as a part of the ordering procedure. Delivery costs depend on the value of the order and the delivery service chosen. Gloria Bass Design reserves the right to divide the order into partial shipments. In this case, your credit, charge or debit card will only be charged for a single shipment.
Upon delivery, a signature confirmation by a person of the age of majority is required for all Gloria Bass Design orders. You acknowledge that any person taking delivery of the products at the designated address shall be deemed to have done so with your authorization.
Customers are responsible for all costs associated with taxes or customs where applicable. Customers are also responsible for fees associated with delivery to an incorrect address. Once the package is delivered and signed for, it becomes the sole responsibility of the customer.
Orders will be shipped out from Tuesday-Thursday (if next day delivery) and never on weekends.
For orders to the USA, all shipments will be sent with a CUSMA (Canada, US, Mexico Agreement) certificate of origin and there will not be any applicable duties. For orders to countries of the European Union, the appropriate CETA (Comprehensive Economic and Trade Agreement) paperwork will be supplied, as will CPTPP (Comprehensive and Progressive Agreement for Trans-Pacific Partnership) documents for countries in the Asia-Pacific region.
PROBLEMS OF DELIVERY
Any failure to deliver or a delivery exceeding ten (10) business days from the shipment date or any discrepancy between ordered and delivered product(s) should be promptly reported to us by emailing info@gloriabassdesign.com or by calling +1-514-933-7062.
IN-STORE PICK-UP
Your item(s) will be available within 10 days after the order has been placed. During high volume periods, delays may occasionally occur due to unforeseen factors or events outside our control. Gloria Bass Design shall not be held liable for any delay or failure to make your order available for collection within the estimated delivery time. Prior to collecting your order, you will receive an email confirmation stating your order is ready to be collected from the Boutique.
- When collecting your order, you must bring: 1. Proof of your purchase (either digitally or printed) 2. Original method of payment confirmation 3. Government-issued photo identification 4. Confirmation email from Gloria Bass Design.
- If you wish to designate another person to collect your order, they must bring: 1. A forwarded copy of your proof of purchase (printed) along with your written consent 2. Original method of payment confirmation 3. A copy of the purchaser’s government-issued photo identification 4. Representative’s government-issued photo identification 5. Confirmation email.
Before taking possession of your order, you or your designate must sign our ‘Order Delivery Slip’ as proof of delivery and acceptance of your order. No dispute relating to the actual delivery is possible if the parcel is deemed to have been delivered, our records being considered proof thereof. If for any reason you do not wish to comply with the terms and conditions within our “IN-STORE PICK-UP” policy, you will not be able to use our “IN-STORE PICK-UP” service.
RETURN POLICY
Due to the individual craftsmanship involved in every piece produced in our atelier, Gloria Bass Design does not issue refunds. You may exchange merchandise in accordance with the exchange policy set forth below.
Exchanges of merchandise which are not in compliance with the conditions and time frames set forth below may be rejected. All goods must be returned unworn and in original showroom condition. Gloria Bass Design will not accept for exchange any merchandise that shows signs of wear, or has been used or altered from its original condition in any way.
Store credits are issued once merchandise has undergone a quality control check. Return shipping fees are the responsibility of the buyer. Gloria Bass Design may refuse any returns that do not comply with our conditions stated above.
A return authorization number is required for any returns. Please call us at 1-514-933-7062 to request an authorization number. Returns must be shipped within seven (7) days of receipt of the merchandise, or they will not be processed.
All sales are final on custom orders and one-of-a-kind pieces and are not returnable due to the rarity of the gemstones and the difficulty in finding replacements. However, we will gladly provide the necessary alterations to a piece so that it fits perfectly. Please call us or provide us with a telephone number where we may reach you to guide you through this process.
Please ensure that your ring size is correct. We will do everything we can to ensure a perfect fit, however it remains the customer’s responsibility to provide a correct ring size. We will adjust a sizing minimally without charge except for shipping.
COPYRIGHT
All text, graphic, logos, images, digital downloads, and data compilations, both individually and as they are compiled on the Website, and all software found on the Website are the property of Gloria Bass Design and are protected by Canadian and international copyright laws.
DISCLAIMER OF LIABILITY
Neither Gloria Bass Design, nor its affiliates, make any representation or warranty of any kind, express or implied, including without limitation that the Website will be uninterrupted or error-free, that defects will be corrected, or that the Website, including the server that makes it available, is free of viruses or other harmful components. Except as otherwise provided by applicable laws, in no event shall Gloria Bass Design, its affiliates, and each of their respective directors, officers, employees, agents, contractors, successors, and assigns, be liable for any direct, indirect, special, incidental, punitive, consequential or other damages arising out of or related to the use, inability to use, authorized use, performance or non-performance of the Website, as well as to the damages for lost profits, business interruption or the loss of data or information, even if Gloria Bass Design was previously advised of the possibility of such damages and regardless of whether such damages arise in contract, tort, under statute, in equity, at law or otherwise.
